LEGALITIES An overview of the legal principles that apply to your session. DEPOSIT A non-refundable deposit of $150 is due by the Client in order to secure the Photographer's services. The deposit shall be applied to the total session fee. The total remaining balance is due on the day of the session. Session fees may be paid ahead of time. Payments can be made when an electronic invoice is received. CANCELATIONS Should the Client need to cancel the session, notice must be given at least 48 hours before the Photographers services are required. The deposit paid is non-refundable, however, it may be applied to a new session date up to ONE reschedule. Rescheduling indefinitely is not permitted due to the volume of customers requiring dates. RESCHEDULING In the event that the Client requests to reschedule a photographic session with more than 7 days notice, the deposit will be applied to a rescheduled session. Reschedules must be within the same calendar year. Clients are allowed one reschedule before their deposit is forfeited and another must be paid to schedule a session. If weather requires the Photographer and Client to reschedule, that will not count as a rescheduling towards deposit forfeiture. PRIVATE ONLINE GALLERY The Photographer shall make the edited digital photos available to the Client through an online gallery proofing website. These proofs shall be available to the client within the agreed upon time of approximately 2-3 weeks. Clients will be able to view the photos to choose prints from. WEB-SIZED FILES & SOCIAL MEDIA FILE SHARING The photographer shall make web-sized (1024px) digital files of the edited photos available for download without any watermark. The Client may share photos/blog post links and social media albums. When uploading to a Facebook or Instagram, the client shall credit the photographer's Instagram (@thegregmurray) or Facebook (facebook.com/gmurrayphoto) accounts in the post description. PRINT CREDITS & DIGITAL FILES Digital files with printing rights may be purchased for $275. All sessions come with photo print credits of $100 toward canvas, metal, and fine art prints. IMAGE MANIPULATION The Client may not add a filter or do any other kind of image manipulation to the photos at any time, as it would then be an incorrect representation of the artists work and potentially reflect poorly on the professional. Image cropping is acceptable for posting on Instagram or for Facebook profile and banner photos. ARTISTIC RIGHT The Photographer retains the right of discretion in selecting the photographic materials released to the Client. The Client shall receive a gallery of photographs to select from and shall not receive any photographic materials not presented to the Client. Only edited images will be delivered to the client. No unedited images will be delivered to the client. The photographer has the right to decline any requests by the Client to edit any specifically requested images that the photographer deems not up to par with the rest of the work. The photographer has the right to decline any "extreme" editing requests, such as but not limited to background changes, added effects, and body modification. The Photographer also retains the right to make adjustments to the photographs in post-processing as the Photographer deems within their creative control. SATISFACTION & ACCURACY The Client agrees that the work delivered will be of a similar style and caliber to those photographs on our Facebook page and website and that the Photographer will have complete creative control during the photographs and in post-processing. The images will be delivered in JPEG format with a mix of color and black and white images, deemed appropriate by the photographer. COPYRIGHT Greg Murray Photography hereafter “Photographer”, owns the copyright to all images. All created photographs are protected by the United States copyright laws. It is illegal to print, copy, scan, edit or reproduce photographs or digital images created without the written consent of the photographer. The Photographer reserves the right to use photographs from your session for advertising, display, website promotion, photographic contests, publications, or any other purposes chosen by the Photographer. The Photographer shall retain copyright ownership of all works created in the course of this contract, including but not limited to all images in their original and processed formats. It is understood that any duplication or alteration of original images is strictly prohibited without the written permission of the photographer. Alterations include, but are not limited to, application of filters or modifications of any kind. Cropping is acceptable for social media purposes, such as Facebook profile photos and square Instagram posts. If any of these actions are performed, the photographer reserves the right to contact you and request the photo(s) be removed as they would no longer be accurate representations of the Photographer's work. PRINTING All prints and products are made by various vendors that cater to professional photographers and use the most sophisticated printing and color correction processes. They are high quality prints and products. We require that the out clients print through these services to ensure that products are the best quality. It's our job to ensure that you get the best artwork possible. There are many online printers that offer low printing prices without the quality that you deserve. We encourage you to set up an appointment and visit our studio to see examples after our session. RETENTION OF DELIVERED FILES Once the JPEG files are delivered to the client, it is the client's sole responsibility to protect and retain their images for the future. It is highly recommended that the digital files or USB drives be duplicated and stored in multiple locations that are cool and dry. (Technology can be fickle. One of the best ways to ensure the client's images will last for generations is for the clients to print them.) If the Client requires old files to be duplicated by the Photographer, and they are still within the Photographer's possession, a restocking fee may be applied. The Photographer only guarantees that the photographs will be available for up to six months from the delivery of the online gallery. After the six month mark, the Photographer no longer guarantees that the photographs will be available. SAFETY The Client assumes all responsibility for their PET(S) or any other subjects during the shoot, including any and all destruction of personal, business or public property, personal injury or illegalities. Know your PET(S) and their behavior and limitations before bringing them to any public area. Please disclose any behavioral or aggression issues before the shoot. You must include whether your dog(s) has attacked, bitten other animals, people, etc… The client understands that Greg Murray Photography reserves to right to terminate the shoot(s) and leave the location of the shoot(s) if he experiences inappropriate, threatening, hostile or offensive behavior from person(s) or the PET(S), other people in the area near the shoots(s), or in the event that his safety is in question. The Client understands that Greg Murray Photography is limited by the rules and guidelines of the location(s) and site management of the shoot(s) and that the client is responsible for fines associated with breaking any laws or ordinances. Greg Murray Photography will offer technical recommendations only. LEASHES The client must show up to the session with their dog(s) on a leash. If client has a flexi/retractable leash, it must be set at no longer than 6 feet. Please note that retractable leashes are illegal in Lakewood, Ohio.
